No matter where you live in the world, you’ve likely heard news stories on the fact that vaping while driving could result in prosecution. Which begs the question, is the act in itself of vaping and driving actually illegal? The good news is, the answer to this question is far less straightforward than news sources would lead you to believe and often greatly exaggerated. Is It Illegal to Vape While Driving?

To help put your mind at ease, there is no law that is specifically directed at vaping while driving, making the act in itself not illegal. Having said that, you can still get charged with careless driving if your vaping results in acts that can be seen as careless driving, such as cloud chasing. Having said all of this, your state may classify vaping devices as “portable electronic devices”, which can be put in the same classification as cell phones – which are certainly illegal to be used while driving. tells us why you can still get busted for vaping while driving, even though it’s not technically illegal:

“There are several avenues a law enforcement official could take to issue a citation for vaping and driving. For example, every state has a law regarding texting and driving. In many states, the language of the texting and driving laws pertains to use of a “portable electronic device” while driving. As with smoking cigarettes, it just makes good sense to do so. No matter where smoke is coming from, it can obstruct your vision, making driving automatically much more dangerous.

Where To Store Your Device Whilst Driving

In order to prevent a safety hazard when reaching for your vape device while driving, you should always keep it in an accessible place. This means an area of your car where you do not have to physically open a compartment to retrieve it and it’s able to be safely and quickly grabbed.

“A common occurrence is your device going missing whilst on the move, possibly because of taking a sharp corner or going over a bump. Under no circumstances should you try to retrieve it whilst driving, rather aim to keep your device in a safe, accessible space in the first place. Drink holders and side door compartments are usually a safe bet, whilst glove compartments are advised against due to reaching over to the passenger side increasing the likelihood of loss of control.”
